Kelly Peterson, Utah Lawyer, Faces Racketeering Lawsuit

When one thinks of R.I.C.O, the Racketeering in Corrupt Organizations Act, the mind usually conjures images of Al Capone like gangsters taking the 5th to avoid “sleeping with the fishes.” Not a small town Utah divorce attorney.

Kelly Peterson, however, seems to want to keep this lawsuit out of the limelight. He filed a motion on the case, currently in the 4th Utah District Court, to seal all the case files. This has caused many to speculate that Mr. Peterson is afraid of what might actually come out when this case goes to trial. Sealing a case is an extraordinary measure rarely used except when information can be damaging to the public interest.

So what, exactly, is Mr. Peterson afraid of?

It seems that Kelly Peterson, along with his client, one Alyssa Alanis are accused of using his privileged position to enter into a sexual relationship with Miss Alanis in exchange for representing her in custody and divorce matters.

Legal representation for sex hardly seems to rise to the level of racketeering. Unless of course, that sex was exchanged for money or something else of value. Then it becomes prostitution. Prostitution is definitely a R.I.C.O. violation.

As Nixon learned, its not the crime itself that will destroy you, its the cover-up. So, again under R.I.C.O, it is the conspiracy to cover up the crime that makes it even more sinister.

The complaint also alleges that Mr. Peterson gave Miss Alanis an STD. That STD is herpes. The complaint states that Mr. Peterson has the disease as evidenced by cold sores on his facial area. It also alleges that Miss Alanis tried to blame the complainant for the STD, but he tested negative for Herpes.

The Complainant also stated that Kelly Peterson and Alyssa Alanis placed his unborn child in jeopardy of contracting the STD, for which their is no known cure.

Miss Alanis, who claimed to be destitute when she was prosecuted by Spanish Fork, Utah for Assault and Domestic Violence (she pled no contest) relied on a public defender paid for by the taxpayers. While her case made its way through the criminal system, somehow she managed to maintain the services of Kelly Peterson, an attorney that charges between $250-$300 per hour.

    Utah regulates attorney-client sexual relations under misconduct. Rule 8.4(g) provides that it is professional misconduct for a lawyer to: “engage in sexual relations with a client that exploit the lawyer client relationship.” n67 Like California, Utah focuses on the exploitative nature of a sexual relationship before prohibiting it. Unlike California, however, Utah creates a rebuttable presumption that an attorney-client sexual relationship is exploitative, except for a spousal or a preexisting consensual relationship. n68

    The Comments to the Utah rule emphasize that the policy behind their rule is basically to “proscribe sexual exploitation of the lawyer’s client.” n69 Moreover, the comments eschew that in an attorney-client sexual relationship, the lawyer “may be exploiting the client’s trust in the lawyer, the client’s vulnerability in a stressful situation, or the lawyer’s superior professional position.” n70 Such exploitation, the comment stresses, “compromises the lawyer client relation-ship.” n71 Like North Carolina, Oregon, and Minnesota, Utah’s rule weighs heavily against sexual relations.     If Alyssa Allanis was giving him sex in exchange for legal fees, that amounts to Prostitution. Peterson charges $250 per hour, so that is pretty expensive sex. He should have hired an escort, it would have been cheaper.

    Unless Allanis is blackmailing him to represent him after having a sexual relationship with him, or because of it. Either way, this is probably more expensive than he realized.

    Never mix business with pleasure.

    Is this a common practice in Utah with lawyers? He would have been disbarred anywhere else by now, or in jail!

    I hope they throw the book at this creep! Taking advantage of a poor helpless girl on welfare! Then giving her an STD! What a scumbag! This is why people hate lawyers! This guy gives the whole profession a bad name!

    Dear Admin. Kelly Peterson’s “issues” go much deeper than this. You should do some additional digging on cases he’s been involved with Special Master Sandra Dredge. I can’t wait to read what else you are going to find and expose because it will be sordid…just like his herpes.

    Not Surprised….. He is involved in the Utah County Family Court Fruad along with his other counterparts. Now this, why does he still have a License? You only ask for things to be sealed if you’re scared. I hope all his shit gets laid out for all to see!!
